Reviewer Nepal is committed to protecting the privacy of its Users and Business Users. This Section sets out how Reviewer Nepal collects, uses, discloses, and safeguards personal information in accordance with Article 28 (Right to Privacy) of the Constitution of Nepal, the Individual Privacy Act, 2075 (2018), the Individual Privacy Regulation, 2077 (2020), the Muluki Criminal (Code) Act, 2074 (2017), the Electronic Transactions Act, 2063 (2008), and other applicable laws of Nepal, read together with our Privacy Policy.
Reviewer Nepal may collect personal information such as name, gender, date of birth, contact details, login credentials, device and usage data, location data, photographs and videos submitted with reviews, and business ownership or identity documents provided by Business Users. Certain categories of information - including caste, ethnicity, political affiliation, religious faith or belief, physical or mental health, sexual orientation, and property details - constitute Sensitive Personal Information and receive heightened protection under this Section.
Reviewer Nepal collects personal information only with the consent of the individual concerned, except where collection or use without consent is permitted under prevailing Nepalese law, such as for criminal investigation, under a court order, or for the maintenance of national security or public order. Personal information collected is used solely for the purpose disclosed at the time of collection, including:
Reviewer Nepal does not process Sensitive Personal Information unless (a) it has been voluntarily and knowingly made public by the individual concerned, (b) processing is necessary for diagnosis, treatment, management, or delivery of health services or emergency assistance, or (c) processing is otherwise permitted or required by applicable law.

Where the Platform processes personal information relating to a minor, such information shall only be processed with the consent of the minor's parent or legal guardian and where doing so is in the minor's interest, consistent with the Individual Privacy Act, 2075 (2018).

Where personal information is transferred, stored, or processed outside Nepal, including through cloud infrastructure or technology partners, Reviewer Nepal shall take reasonable steps to ensure that such information continues to receive a level of protection consistent with the Individual Privacy Act, 2075 (2018).
Where a data breach is reasonably likely to result in harm to affected individuals, Reviewer Nepal will take prompt remedial action and, where required by applicable law, notify affected Users and the appropriate authorities.
Any violation of an individual's privacy under this Section may be pursued before the competent District Court in accordance with the Individual Privacy Act, 2075 (2018), and may attract imprisonment of up to three years, a fine of up to NPR 30,000, or both, in addition to compensation for the aggrieved party. Users may also submit privacy-related complaints to legal@reviewernepal.com, and Reviewer Nepal will investigate and respond within a reasonable time.
This Section must be read together with our separate Privacy Policy, which provides further detail on our data practices. In the event of any conflict, the more specific and User-protective provision shall apply, provided that neither derogates from applicable Nepalese law.
By creating an account, posting reviews, uploading photographs or videos, claiming a business profile, accessing the API, or otherwise using Reviewer Nepal, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. You further acknowledge that all reviews are the independent opinions of their respective authors and that Reviewer Nepal and Spectra Nepal Pvt. Ltd. function solely as neutral technology service providers facilitating the publication and management of user-generated content. Except where expressly required by applicable law or a final order of a competent court, Reviewer Nepal and Spectra Nepal Pvt. Ltd. shall not be held responsible or liable for the content, accuracy, legality, or consequences of any user-submitted review or rating.
